˙✦ General Rules ✦˙

1) Full payment is to be made via Paypal invoice before I begin the commission. I do not take any other form of payment to protect myself as an artist, your commission will not started until payment is received.

2) I reserve the right to deny your request for any reason. Projects that are out of my scope, I am not comfortable with, or are actively crossing the guidelines set in this TOS will be denied.

3) Pricing of commissions is subject to case by case changes. Depending on the details featured within character design or backgrounds, additional fees may be added and agreed upon at time of purchase.

4) Visual references in some form are mandatory. I do not take custom character design commissions and require references of you character, as well as anything you'd like to be featured in your piece alongside them (clothing, accessories, detailed background elements, etc.).

5) Finished artwork will be posted to my social media(s). Featuring commission work on my page allows future clients to better know the quality they can expect. Your account will be tagged / mentioned unless you'd rather remain anonymous.

˙✦ Disclaimer ✦˙

✶ By purchasing my commission services, you have automatically agreed to this TOS and will be held accountable for reading through it fully.

✶ Please read through the entirety of my TOS before commissioning me, your commission will be refused if these terms are not followed.

✶ If you are uncomfortable with these terms and/or you are unwilling to agree to the following conditions, your request will be denied.

✶ Clients are not permitted under any circumstance to use any part (sketch, line art, full piece) of commissioned work from GremlinInABox in any block-chain related technology, which includes non fungible tokens (NFTs), cryptocurrency, or future technology. Using any commissioned work is also strictly prohibited from use in any advertising or profits associated with block-chain related technology including non fungible tokens (NFTs), cryptocurrency, or future technology.

✶ Any aspect of work by GremlinInABox may not be used to train, validate, or test any public or otherwise neural network or artificial intelligence.

˙✦ User Agreement ✦˙

1) By commissioning me you have agree to having both read and accepted all of the terms stated and described herein.

2) You agree here to the policy of using the art strictly for personal, non-profit purposes with image credit to me.

3) Violators of said terms will be added to a blacklist indefinitely without appeal, as well as any additional appropriate actions will be taken to insure my safety as a creator.

— Client —

✶ You, as the client, will be expected to have read my full TOS and understand my general prices before requesting a commission.

✶ You may display my work on external sites, as long as it is visibly credited and linked back to me. Credit of some form is always required.

✶ You may not upload my work in any gallery that is intended to display solely your work (such as portfolios).

✶ You may not claim my work as your own.

✶ You are not authorized to change, modify, or edit my works without permission.

✶ You are not authorized to trace over the commissioned piece in any way, including the use of the artwork as a base.

✶ You may use the commissioned piece for personal use, which includes but is not limited to: profile pictures, phone/tablet/desktop wallpapers, and profile displays.

✶ You reserve the right to print or create other physical reproduction of the commissioned piece as long as it is for your personal use only (i.e. not for sale).

✶ Do not upload unwatermarked files publicly unless first discussed.

✶ You may not use the commissioned piece for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, flyers, etc.) unless otherwise discussed.

✶ Harassment will not be tolerated. This includes inappropriately worded comments on my social platforms and private messages. I reserve the right to place anyone on my blacklist over harassment of any kind.

✶ Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.

✶ If you, as the client, wish for your request to be anonymous, it must be stated during the ordering process.

— Artist —

✶ By commissioning me, you are purchasing my service as a digital artist only. No physical artwork will be sent to you.

✶ I reserve the right to decline any project or client for any reason.

✶ I reserve the right to refund you the full commissioned price if I no longer wish to work on your project for any reason.

✶ I reserve the right to post your finished artwork on my social media for any reason, whether you would like to be tagged or left as anonymous will be discussed before it is posted.

✶ I will not create any commission work including the following: Offensive and/or bigoted content (i.e. racism, homophobia, transphobia, pedophillia, incest), explicit NSFW and fetishes, erotic content featuring masculine body types, gore or excessive injury, and certain medias/fandoms.

— Copyright —

✶ I reserve the right to sign and/or watermark my own work. I will send you a full resolution, unwatermarked image via Google Drive, as well as a smaller watermarked image for posting publicly and sharing.

✶ I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for future commission sales or self-promotion.

✶ In the case of commissioned pieces featuring a client's person character or design, I will not claim rights to the design and therefore will not reuse/resell the artwork for personal or commercial projects.

— Ordering / Requests —

✶ Your commission slot is only confirmed upon receiving a reply from me to discuss details.

✶ I reserve the right to make changes to your request (due to artistic style or complexity) as I see fit unless otherwise discussed. To guarantee the total accuracy of your commission request, please make note of the required details and elements before the piece in started.

✶ If your commission is highly detailed in any aspect, I have the right to charge a fee to include these details (this fee will be stated before the transaction). You hold the right to make changes to your commission request (e.g. change a character, agreeing to simplified design changes) before the transaction is complete.

✶ Please word your request clearly and concisely with minimal abbreviation.

✶ I will need visual references of the characters and any designs you will to be included your commission request (text descriptions may also be added, but can not be solely gone off of). I will also request your desired pose, emotion, and composition if you do not wish to leave said things up to my discretion.

✶ Reference sheets provided as reference are asked to be flat color and/or have an unrendered version for ease of color selection.

✶ I ask that all emails, private messages, and comments you send to me are in English. Miscommunication due to mistranslation is solely at the fault of the client.

✶ Before taking part in any transaction, you are required to wait for my reply to discuss further details before the commission is officially taken and started.

✶ After processing and confirmation, I will send you an invoice. You will need to confirm the payment with me before your commission is started.

— Payment —

✶ I am not responsible for any financial mistakes made on your part over the course of this transaction.

✶ I solely accept USD via Paypal as payment, any currency conversions is your responsibly as a client.

✶ Payments through Paypal are sent via invoice method. I will cover the Paypal fees as it is expected from the Artist per PayPal ToS (what you see is what you will have to pay).

✶ I will initiate transaction via invoice to prevent accidental transactions and overpaying. Do not send me any kind of payment until I have confirmed I can accept your commission and have asked for payment. Failure to comply will result in potential cancellation of your commission.

✶ It is expected that you deposit 100% of the price upfront before I start, no exceptions.

✶ After 100% of agreed upon payment is sent, I will begin the sketching process. Said sketch will be sent to you for any necessary changes upon completion before continuation.

✶ I do not accept payment from shared PayPal accounts unless you are not of legal age and use a parent/guardian’s PayPal account.

✶If payment is not made in a timely manner (within 48 hours unless discussed otherwise) after I’ve placed the invoice, the commission will be cancelled. Please reach out if there are any delays or issues preventing payment, repeat failure to pay without contact may result in blacklisting.

— Refunds —

✶ I will refund 100% of the agreed upon payment only if I have yet to state I am working on the sketch.

✶ Once the sketching phase is started, you may be refunded 50% of the initial payment.

✶ Past the sketching phase, there will be no refunds for any reason.

✶ If I cancel a project, I will reimburse lost fees and refund 100% of the original payment.

— Chargeback —

✶ You are not authorized to issue a chargeback for any reason.

✶ If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.

✶ Purposefully issuing a chargeback without contacting me to cancel/refund a commissioned piece will result in immediate blacklisting.

— Deadlines / Queue / Work Speed —

✶ Response to initial order inquiry usually takes up to 3-5 days, unless other wisely stated publicly (e.g. vacation, emergencies).

✶ You reserve the right to set a deadline for you commission. This deadline must be disclosed prior to payment.

✶ I have the right to decline a project based on too short of a timeline.

✶ I will not be held responsible for late delivery for due dates I was not made aware of.

✶ I do not offer rush fees of any kind.

✶ I reserve the right to take a time—which will be estimated at time of replying to your request—to begin your work (depending on your position in queue and the busyness of my schedule) and an additional 4-10 weeks to work on said commission depending on size and complexity.

✶ No harassment over my work speed will not be tolerated, whether publicly on social media or directly to me through private messages.

✶ The order I work on commissions may not be in the order that they were chronologically requested in.

✶ You reserve the right to be notified of any delays.

— Revisions and Feedback —

✶ I will send work in progress updates after payment is complete. These updates will come in the form of .png files as an attachment in the email or private messages.

✶ You are responsible to ensure your request contains the details you want me to follow.

✶Only one guaranteed WIP will be sent during the sketch and coloring phases, but feel free to ask for an update at any given time (within reason of course).

✶ With each WIP sent to a client, I will ask the client to provide feedback to me. If no suggestions are requested, the client is held responsible for their dissatisfaction with incorrect details.

✶ All updates to your commission status can be found on my Trello.

✶ Up to two major revisions can be made during the sketching phase of the commission. Only minor adjustments within reason can be made afterwards.

✶ Any major changes beyond the two allowed must be minimal unless a fee is paid ($25+). Color corrections will be made at the coloring stage free of charge.

✶ Any major changes to the character or design will be subject to additional fee on top of the original price. Said fee will depend on the nature of the change.

✶ After the order is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my fault (e.g. I overlooked details provided in the request).

✶ In the absence of feedback from the client, any changes to the final piece will be subject to a fee.

✶ I will not redraw a completed commission unless payment is received for a second request.

— Final Product —

✶ Due to time or artistic style change, there may be slight difference between the provided samples and the commissioned piece you receive.

✶ The client must respect that my artistic style cannot be altered in any way for a piece.

✶ I reserve the right to reject critiques pertaining to artistic skill and stylization, as well as if the critique reduces the artistic quality of the piece.

✶ Credit to me, as the artist, is required when you share the commissioned piece on social media. Please refrain from posting the unwatermarked final piece as is.

✶ You are responsible for saving any information, images, and other digital data I provide to you.

✶) Any file you paid for will be available from me for a finite time only. After the competition of your commission and the final product has been sent, have no guarantee against accidental deletion or loss.

✶ I am not required to post you commissioned piece on any of my social medias, and if posted, I am not required to keep it there indefinitely.

✶ Feedback of the final received product is permitted after completion through private messages or comments. Any comments that are rude, bigoted, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.
